1. Agreement to Terms

By accessing or using TubeVocab ("Service"), operated by TubeVocab ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes indicates your acceptance of the modified Terms.

2. Description of Service

TubeVocab is an AI-powered English learning platform that helps users learn vocabulary in context using YouTube videos. Our Service includes:

  • Interactive subtitle viewing for YouTube videos
  • AI-generated vocabulary flashcards with translations and contextual meanings
  • Personal vocabulary library management
  • Spaced repetition review system
  • Integration with third-party tools (e.g., Anki)
  • Cross-device synchronization (for registered users)

3. User Accounts

3.1 Account Creation

You may use some features of TubeVocab without creating an account. To access full features, you must create an account by providing accurate and complete information. You may register using email/password or through third-party authentication providers (Google, GitHub).

3.2 Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • You must be at least 13 years old to create an account.

4. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Upload or transmit viruses, malware, or other malicious code
  • Harass, abuse, or harm other users
  • Violate intellectual property rights of others
  • Circumvent any access restrictions or usage limits
  • Resell or redistribute the Service without authorization
  • Use the Service to generate spam or unsolicited communications

5. Intellectual Property

5.1 Our Content

The Service, including its design, features, code, and content (excluding user-generated content and third-party content), is owned by TubeVocab and protected by copyright, trademark, and other intellectual property laws.

5.2 User Content

You retain ownership of any content you create using our Service (e.g., vocabulary cards, notes). By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

5.3 Third-Party Content

YouTube videos and their content belong to their respective owners. TubeVocab does not claim ownership of any YouTube content. Your use of YouTube content through our Service is subject to YouTube's Terms of Service.

6. Subscriptions and Payments

6.1 Free and Premium Plans

TubeVocab offers both free and premium subscription plans. Free users have access to core features with usage limits. Premium subscribers have access to additional features and higher usage limits.

6.2 Billing

  • Premium subscriptions are billed on a recurring basis (monthly or annually).
  • Payment is processed through Stripe, a third-party payment processor.
  • Prices are listed in USD and may be subject to change with notice.

6.3 Refunds

Refund requests are handled on a case-by-case basis. Please contact us at support@tubevocab.com within 7 days of purchase if you are unsatisfied with your subscription.

7. Third-Party Services

Our Service integrates with and relies on third-party services, including:

  • YouTube: Video content and subtitles are provided by YouTube. Use of YouTube content is subject to YouTube's Terms of Service.
  • Google Gemini AI: AI-powered vocabulary card generation uses Google's Gemini API.
  • Supabase: User data storage and authentication.
  • Stripe: Payment processing.

We are not responsible for the availability, accuracy, or content of third-party services.

8. Disclaimers

8.1 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

8.2 AI-Generated Content

Vocabulary cards and translations are generated by AI and may contain inaccuracies. We recommend verifying important information from authoritative sources.

8.3 Learning Outcomes

We do not guarantee any specific learning outcomes or results from using our Service. Language learning success depends on many factors including individual effort and practice.

9. Limitation of Liability

To the maximum extent permitted by law, TubeVocab and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the Service
  • Any unauthorized access to or use of our servers or your data
  • Any interruption or cessation of the Service
  • Any bugs, viruses, or other harmful code transmitted through the Service
  • Any errors or inaccuracies in AI-generated content

10. Indemnification

You agree to indemnify, defend, and hold harmless TubeVocab and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Upon termination:

  • Your right to use the Service will immediately cease.
  • You may request a copy of your data before termination.
  • We may delete your account and associated data after a reasonable period.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good faith negotiation, or if necessary, through binding arbitration.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
